For vehicles and vehicle components, a distinction must be made between statutory defect rights and normal wear and tear. Not every impairment of function constitutes a defect in the legal sense.
Statutory Defect Rights
Statutory defect rights apply in cases of material, manufacturing or workmanship defects in accordance with applicable law and our terms and conditions.
- proper installation
- intended and appropriate use
- no improper handling, modification or opening of the component
For used or refurbished parts, the limitation period for defect claims is reduced to 12 months from delivery, to the extent permitted by law and effectively agreed.
Wear and Tear
Wear and tear occurs as a result of use, age and mileage. It does not constitute a defect if the wear corresponds to the age, mileage and use of the vehicle or component.
Typical wear-prone components include, but are not limited to:
- brake components
- clutch, including dual-mass flywheel
- suspension components and bearings
- engine and transmission mounts
- belts and tensioners
- spark plugs and glow plugs
- filters and operating fluids
- battery
- tires
- seals
- exhaust system
MINI-Specific Characteristics
In MINI vehicles, certain components may be subject to increased mileage-related stress due to design or model-specific characteristics and may therefore wear out earlier.
- timing chain components including tensioners and guides
- high-pressure fuel pump
- water pump and thermostat
- engine mounts
- crankshaft vibration damper
- VANOS components
- turbocharger
- suspension bushings and control arm bushings
Important Note
Assessment is always carried out taking into account age, mileage, use, maintenance condition and the overall technical condition of the vehicle or component.
The replacement of worn components does not constitute a defect.
In individual cases, the applicable statutory provisions and our terms and conditions shall prevail.
